Terms & Conditions


1. These terms and conditions of business are between The Au Pairs Simple Agency (hereinafter called The Agency) and the Client. The Agency will only undertake business on the terms and conditions contained herein. No variation of the terms will be valid unless confirmed in writing by the Agency. The Client is the person who has signed the agreement on the application form.


2. The fees are as follows:

    £125 for au pairs booked for less than 3 months

    £250 for au pairs booked for more than 3 months

    £350 for au pair couples

 

3. After the client has decided to accept the au pair, the client will provide to the agency:

  1. An invitation letter for the au pair
  2. The placement fee which will become due as soon as a place has been offered by the Host Family and accepted by the Au Pair.

   On receipt of the placement fee the Agency will instruct the Au Pair to book their travel arrangements.
   Cheques should be made payable to The Au Pairs Simple Agency.


4. The Agency reserves the right to cancel the booking if the fee is not received within a week from confirmation date and offer the applicant to other families for selection.

 

5. The Agency acts as agents for the purpose of effecting introductions between Clients and Au-pairs and the fees to the Agency are for introduction only. The Agency cannot be held responsible should the Au-pair stay for a shorter time than that agreed with the Client.

 

6. Although the Agency takes every care to check the applicant's details, the Client is strongly advised to satisfy himself/herself as to the suitability of the applicant.

 

7. Refund rights are dependent upon punctual payment of our invoice. If payment of our invoice is not received with the letter of invitation all rights to refund are forfeit.

 

8.The Agency does not accept responsibility for any loss or damage resulting from the Agency's introduction or provision of services or from any acts, omissions or conduct of staff introduced by the Agency.

 

9. The Agency shall not be responsible or liable for any breach by the au pair of the terms of engagement or for any other act or omission whether wilful, negligent or otherwise.

 

10. All information provided to Clients is confidential. Clients transferring information supplied by the Agency and resulting in the engagement of an au pair by a third party will be liable to pay the full fee for that engagement.

 

11. If the Client cancels the booking after the au pair has been engaged and prior to arrival at the Client's home, a cancellation fee of £75 will become payable to cover the cost of the Agency's work. The family will be responsible for any non-recoverable travel expenses incurred by the au pair.

 

12. If the applicant fails to arrive, or leaves within the first 14 days, the Agency will offer a substitute within 14 days of being notified in writing. If no replacement is available after this period, the fee will be refunded less £75 administration charges. If the Client decides, for whatever reason, not to accept the replacement no refund shall be due to the Client. No refund is available if the Client finds an applicant from another source before the expiry of the aforesaid 14 days. Refunds will only be made provided the Client notifies the Agency in writing within 5 days of termination of employment and the Agency's invoice has been paid in full within 7 days of the invoice date.

 

13. The family should notify the Agency of any changed circumstances or variation to their requirements and discuss the implications with the Agency and the au pair.

 

14. Once the au pair has arrived to stay in the family, it shall be agreed that termination must be by two weeks notice by either party. In the event of serious misconduct by one of the parties, the other party shall be entitled to terminate the agreement with immediate effect provided that, should the misconduct be on the part of the au pair, the Client shall be responsible for providing appropriate accommodation for a period of four days from the date of termination.

 

15. The Agency has the right to remove an au pair from a family failing to follow the guidelines or terms and conditions or for giving false information when registering. In these cases, no refund will be available.

 

16. These terms and conditions are deemed to be accepted and agreed by the Client on submission of the registration form to the Agency.

 

17. Au-pairs must be paid a minimum of £60 per week and an Au-pair Plus a minimum of £85 per week.

 

18. If the Client decides not to accept the applicant after an invoice has been raised no refund will be made. A credit for a period of 3 months from the invoice date will be given. Once a Client has accepted an applicant and an invoice has been raised following this acceptance, the Client is liable to pay the full amount stated on the invoice.

 

19. In all cases if a substitute is offered by the Agency and refused by the Client no refund or credit is due.

 

20. Although every effort is made to ensure that any information given to a Client is correct, the Agency cannot be held responsible for any incorrect information.
